Judge is calling in the jury on day two of the UnruhJohn trial. Jury is 10 women and four men. Jury instructions are going on now.
After jury instructions there will be opening statements from the prosecution and defense.
The courtroom is packed, which is not typical for cases around here.
They read instructions at the beginning and the end. The end instructions are given before deliberations and are longer.
At least, they call them instructions in the courtroom. Maybe they have a different technical name for them in the legal world.
Jake Rodenbiker is presenting prosecution opening statements.
He says Randy Albaugh told officers with his last words that Unruh
had stabbed him.
Argument between the two men began after Albaugh had sex with a girl in the bathroom at Unruh's home, Jake said.
Unruh called 911 to report Albaugh as an intruder after he stabbed him, Jake said.
Unruh told police the woman stabbed Albaugh.
Officer had to use Taser on Unruh while Albaugh died.
Later Unruh said he stabbed Albaugh but it was an accident.
Later said he was defending himself. When told Albaugh had died, Unruh said he was defending his property.
What he was doing was not an accident, Jake said.
About 100 pieces of evidence will be presented during trial.
Now Tom Tuntland will present defense statement.
Yes, jajbears, Jake said they had been drinking throughout the day.
Tom said evidence will show Unruh stabbed Albaugh fatally.
He wants jury to pay attention to the fact that this happened at Unruh's home.
Unruh and Albaugh planned to meet up with a mutual friend the night before and ended up meeting him early on April 15 and stayed at the friend's home.
Eventually friend left them at Grizzlies. They drank margaritas.
Albaugh and Unruh later went to Hooters where they met the woman who later went back to Unruh's home with them.
They hadn't known her before that. Tom says she told them she was looking for some excitement.
Albaugh had his girlfriend
bring him more money.
Unruh's 10 year old daughter was there when they got home and was playing a dance game. Albaugh and the woman sat down. Tom said conflict began then.
Unruh will testify Albaugh and woman were fooling around under a blanket, and so will his daughter, Tom said.
Unruh, Albaugh, the woman they met,Unruh's daughter and a woman who occasionally stayed at Unruh's home were present at the time of the stabbing, though not all of them were in the room where the stabbing occurred.
Unruh told Albaugh to quit fooling around with the woman, then told him to leave in Unruh's truck.
They didn't leave. Unruh says they went to his bed, then went into bathroom when Unruh told them to stop. Tom says woman and Albaugh
had sex "and it was loud" in the bathroom.
Unruh tried to get in, but door was locked. Tried using tools, including a bread knife.
Albaugh left bathroom, Unruh had bread knife in his hand. Unruh was yelling at Albaugh, Unruh backed up and Albaugh rushed him, Tom said.
Unruh "acted instinctively" and struck Albaugh in the chest with the knife. That was not the lethal wound, Tom said.
Legally yours the state did not mention a number of witnesses. Their opening was far shorter than defense's, probably between five and 10 minutes.
Jury will hear 911 calls, Tom said. Unruh was obviously drunk when he made the call, he said.
